Immigration Status

The Housing Authority shall advise applicants and residents, that they will be required to submit evidence of citizenship or eligible immigration status.      

            This applies to all families regardless of any documentation of the person’s identity that may have been previously obtained.  An extension of time may be granted to obtain the evidence needed but shall not exceed thirty (30) days.  The extension and the length of time provided will be determined on a case by case basis.

            The decision to grant or deny an extension must be in writing and the notice must specify the extension period granted (which shall not exceed thirty (30) days).  If the extension is denied, the notice shall explain the reasons for the denial.

            Applicants with no eligible family members do not qualify for assistance.

            Applicants whose family members include those with citizenship or eligible immigration status, and those without citizenship or eligible immigration status (mixed family) qualify for prorated assistance.           

            Non-citizen student applicant or resident, living alone or accompanied by immigrant spouse and/or children do not qualify for assistance.

            Non-citizen student applicant or resident whose family members include a citizen spouse and citizen children are eligible for prorated assistance.

Each family member residing in the unit regardless of age must submit evidence of citizenship or eligible immigration status. Family members are required to submit evidence of eligible status only one time during their continued occupancy of the subsidized unit.

·         For U.S. citizens or U.S. nationals, evidence consist of a signed declaration of U.S. citizenship or U.S. nationality.

The declaration is a computerized form, each adult residing in the dwelling unit must sign the form. For each child residing in the unit the form must be signed by an adult responsible for the child.

·         For non-citizens who are 62 years of age or older or who will be 62 years of age or older, the evidence consists of a signed declaration of eligible immigration status and proof of age document.

·         Verification is required for all other non-citizens who claim eligible immigration status.  Eligible immigration documents (originals only) are;

                        Resident Alien Card (1-551)

                        Alien Registration

                        Arrival Departure (1-94)

                        Temporary Resident Card ((1-688)

                        INS receipt for a replacement card
